1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legal agreement between you ("Renter," "you," or "your") and Silvain ("Company," "we," "our," or "us") regarding your use of our vehicle rental services in Singapore.

By reserving or renting a vehicle from Silvain, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Definitions

"Vehicle" means any car, automobile, or motor vehicle rented from Silvain
"Rental Period" means the time between vehicle pickup and return as specified in the Rental Agreement
"Rental Agreement" means the specific contract signed at the time of vehicle pickup
"Authorized Driver" means the Renter and any additional drivers approved by Silvain
"Damage" means any loss, harm, or impairment to the Vehicle during the Rental Period

3. Eligibility and Requirements

3.1 Driver Requirements

To rent a vehicle from Silvain, you must:

Be at least 21 years of age
Hold a valid driver's license for at least 1 year
Provide a Singapore driver's license or valid International Driving Permit (IDP)
Present valid government-issued identification (passport or NRIC)
Provide a credit card in your name for security deposit

3.2 Additional Drivers

Additional drivers must meet the same requirements and be registered at the time of vehicle pickup. Unauthorized drivers are strictly prohibited and will void insurance coverage.

4. Reservations and Bookings

4.1 Reservation Process

Reservations can be made through our website, email, or phone. All reservations are subject to vehicle availability and confirmation by Silvain.

4.2 Reservation Changes

Changes to confirmed reservations must be made at least 48 hours before the scheduled pickup time. Changes are subject to availability and may incur additional charges.

4.3 Cancellation Policy

Cancellations 7+ days before pickup: Full refund of any deposit
Cancellations 3-6 days before pickup: 50% of first day's rental fee charged
Cancellations less than 3 days before pickup: Full first day's rental fee charged
No-show: Full rental period charged

5. Rental Rates and Payments

5.1 Rental Charges

Rental rates include:

Daily rental fee for the selected vehicle collection
Comprehensive insurance coverage
24-hour roadside assistance
Collection-specific inclusions (parking guides, heritage documentation, etc.)

5.2 Additional Charges

The following may incur additional charges:

Additional drivers: SGD 30 per driver per rental period
Late returns: Pro-rated hourly rate (1/24th of daily rate per hour, 1-hour grace period)
Fuel: Vehicle must be returned with same fuel level as pickup
Cleaning: SGD 150 for excessive soiling requiring professional cleaning
Delivery/collection service: Variable based on location
Traffic violations, parking fines, ERP charges incurred during rental

5.3 Security Deposit

A security deposit of SGD 1,000 to SGD 3,000 (depending on vehicle collection) is required and will be pre-authorized on your credit card. The deposit is released 7-14 business days after vehicle return, subject to inspection and any outstanding charges.

5.4 Payment Terms

Payment is due at the time of vehicle pickup. We accept major credit cards (Visa, Mastercard, American Express). Cash payments are not accepted.

6. Vehicle Use and Restrictions

6.1 Permitted Use

The Vehicle may only be used for lawful purposes and in accordance with Singapore traffic laws. The Vehicle must be operated solely on paved roads suitable for the vehicle type.

6.2 Prohibited Uses

You agree NOT to:

Allow unauthorized persons to drive the Vehicle
Use the Vehicle for commercial purposes (deliveries, ride-hailing, etc.)
Drive under the influence of alcohol or drugs
Use the Vehicle for racing, competitions, or testing
Transport illegal goods or substances
Smoke in the Vehicle
Transport pets without prior written approval
Take the Vehicle outside Singapore without written permission
Exceed posted speed limits or drive recklessly
Transport more passengers than the Vehicle's capacity

6.3 Geographic Restrictions

The Vehicle is only permitted for use within Singapore unless otherwise agreed in writing. Unauthorized cross-border use voids all insurance coverage.

7. Insurance and Liability

7.1 Insurance Coverage

All rentals include comprehensive insurance coverage as required by Singapore law. Coverage includes third-party liability and damage to the Vehicle, subject to the deductible specified in your Rental Agreement.

7.2 Deductible and Liability

In the event of damage, theft, or loss of the Vehicle, you are responsible for the insurance deductible amount, typically SGD 2,000 to SGD 5,000 depending on the vehicle collection and circumstances.

7.3 Insurance Exclusions

Insurance does NOT cover:

Damage caused by prohibited uses outlined in Section 6.2
Damage to tires, wheels, undercarriage, or glass (windscreen)
Personal belongings left in the Vehicle
Loss of use or consequential damages
Damage caused by gross negligence or willful misconduct

7.4 Accident Procedure

In case of accident, theft, or damage, you must:

Contact Silvain immediately at +65 6392 8471
Obtain a police report if required by law
Not admit liability or make agreements with third parties
Document the incident with photos and witness information
Complete an accident report form provided by Silvain

8. Vehicle Condition and Inspection

8.1 Pre-Rental Inspection

At pickup, you will conduct a vehicle inspection with our staff. All existing damage will be documented and photographed. You are responsible for reporting any undocumented damage at this time.

8.2 Return Condition

The Vehicle must be returned in the same condition as received, normal wear and tear excepted. Any new damage will be assessed and charged accordingly.

8.3 Maintenance Responsibilities

You are responsible for checking and maintaining proper fluid levels (engine oil, coolant) during the rental period. Any mechanical issues should be reported to Silvain immediately.

9. Early Termination and Extensions

9.1 Early Return

Early return of the Vehicle does not entitle you to a refund for unused rental days unless otherwise agreed in writing.

9.2 Rental Extensions

If you wish to extend your rental period, contact us at least 24 hours before the scheduled return time. Extensions are subject to vehicle availability and will be charged at the prevailing daily rate.

10. Termination by Company

Silvain reserves the right to terminate the rental and repossess the Vehicle without notice if:

You violate any terms of this Agreement
The Vehicle is used for prohibited purposes
You provide false information
Payment is not received or credit card is declined
The Vehicle is abandoned or appears to be abandoned
You are arrested or the Vehicle is seized by authorities

You will be responsible for all costs associated with repossession and will not be entitled to a refund.

11. Limitation of Liability

Silvain provides vehicles "as is" and makes no warranties regarding fitness for particular purposes. To the maximum extent permitted by Singapore law:

Silvain is not liable for indirect, consequential, or incidental damages
Our total liability is limited to the total rental fees paid
We are not liable for delays, breakdowns, or mechanical failures beyond our control
We are not responsible for personal property left in vehicles

12. Indemnification

You agree to indemnify and hold Silvain harmless from any claims, damages, or expenses arising from your use of the Vehicle, including but not limited to traffic violations, parking fines, accidents, and third-party claims.

13. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy and Singapore's Personal Data Protection Act. By renting from Silvain, you consent to our collection and use of your information as described in our Privacy Policy.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Republic of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the Singapore courts.

14.2 Dispute Process

In the event of a dispute, we encourage you to contact us directly at [email protected] to seek an informal resolution before pursuing legal action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the specific Rental Agreement and our Privacy Policy, constitute the entire agreement between you and Silvain.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

15.3 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

16. Changes to Terms

Silvain reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after changes constitutes acceptance of the modified Terms.

For rentals already in progress or confirmed reservations, the Terms in effect at the time of booking will apply.
